1. Scope and Applicability

These terms apply to ChargeFog Inc., its branded hardware, software, internet services, and any content we publish. Certain offerings may include additional terms; where there is a conflict, the product-specific terms prevail to the extent of the conflict.

3. Definitions (Plain Meaning)

  • “Products” means ChargeFog-branded devices, accessories, packaging, and documentation.

4. Acceptable Use

You must use our Products and Services lawfully and responsibly. Prohibited activities include: reverse engineering except to the extent permitted by law; introducing malware or security exploits; infringing intellectual property; circumventing technical protections; interfering with network integrity; and using our brand or content to imply endorsement without written permission.

5. Accounts, Security, and Content

  • You are responsible for safeguarding account credentials and for activities under your account.
  • We may suspend or terminate access for abuse, fraud, or security risk.
  • Content you upload must be lawful and you must have rights to it. You grant us the limited rights necessary to operate the Service and provide features you request.

6. Orders, Pricing, and Risk of Loss

  • Prices, specifications, and availability are subject to change prior to order acceptance.
  • Orders are deemed accepted when we dispatch a confirmation or ship the Product, whichever occurs first.
  • Title and risk of loss transfer at delivery to the carrier, unless required otherwise by local law.

7. Returns, Refunds, and Exchanges

Eligible returns require original proof of purchase and adherence to the return window provided at the time of sale. Devices must be in good condition with accessories and serials intact. Refund method typically matches the original payment method. This policy does not limit any non-waivable consumer rights.

8. Limited Warranty Summary

ChargeFog provides a limited warranty against defects in materials and workmanship under normal use for a defined period from the date of purchase. The remedy is repair, replacement, or refund at our option. The warranty excludes normal wear, misuse, accidents, modifications, unauthorized repairs, and non-ChargeFog accessories. 9. Software License and Updates

Software (including firmware) is licensed, not sold. Subject to your compliance, you receive a personal, non-transferable, revocable license to install and run the software solely with the associated Product. We may provide updates or patches that are required for security or functionality.

10. Intellectual Property

  • Trademarks: ChargeFog™, the ChargeFog logo, and “Power Without Wires” are trademarks of ChargeFog Inc. Use requires written permission.
  • Copyright: All text, images, videos, software, and documentation are protected by copyright laws and treaties.
  • Patents: Our hardware and methods may be protected by pending or issued patents.
  • Open Source: Some components may include open-source software governed by their respective licenses.

11. Privacy and Data Protection

We collect only what is necessary to deliver and improve Products and Services; we do not sell personal data. We apply reasonable technical and organizational safeguards, retain data only as long as needed, and honor lawful requests to access, correct, or delete personal information, subject to verification and legal exceptions.

12. Cookies and Device Analytics

We may use strictly necessary cookies, functional preferences, and limited analytics to understand performance and reliability. You can manage cookie preferences in your browser or device settings; disabling certain cookies may limit functionality.

13. Safety and Regulatory

  • Use only as directed and with certified power accessories.
  • Follow regional electrical, RF exposure, and recycling guidance provided with the Product.
  • Do not open or modify devices; this may cause injury and void warranty.

14. Environmental and Recycling

We design for durability and responsible materials where practical. Please recycle devices and batteries through qualified e-waste channels. Local regulations may grant additional rights and obligations.

15. Export Control and Sanctions

Products and software may be subject to U.S. and international export, re-export, and sanctions laws. You agree not to export or provide Products or software to prohibited destinations or parties and not to use them for prohibited end uses.

16. Anti-Corruption and Ethics

We prohibit bribery, kickbacks, and improper benefits in all dealings. Partners and suppliers must comply with applicable anti-corruption, labor, and human-rights laws.

17. Third-Party Services

Our Products may interoperate with third-party software or services that have their own terms and privacy practices. We are not responsible for third-party content or service reliability.

18. Disclaimers and Limitation of Liability

To the fullest extent permitted by law, Products and Services are provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ChargeFog is not liable for indirect, incidental, special, consequential, or punitive damages. In no event will our total liability exceed the amount you paid for the applicable Product or twelve (12) months of Service fees, whichever is less.

19. Governing Law and Disputes

These terms are governed by the laws of the State of Wyoming, excluding conflict-of-law rules. The exclusive venue for disputes is the state or federal courts located in Wyoming, and the parties consent to personal jurisdiction there. Where arbitration is required by law or separate agreement, that requirement controls.

20. Changes to These Terms

We may update these terms to reflect changes in our Products, Services, or legal requirements. Material changes will be signaled by updating this page. Continued use after an update constitutes acceptance of the revised terms.
